How to collect consent for outbound AI calls

Get your Shopify store ready for outbound AI calls: update your checkout checkbox, policies and sign-up forms so customers give valid call consent.

US law requires a customer's written consent before an AI voice can make marketing calls to them. A checkbox that only mentions texts does not count. This guide walks you through the 5 changes that set up valid call consent in your Shopify store and sign-up forms.

Before you start: only customers who opt in after these changes go live can be called. Anyone who signed up before agreed to texts, not calls.

What you will change

  1. Turn on the phone checkbox at checkout

  2. Change the wording next to the checkbox

  3. Add a calls section to your Terms of Service

  4. Add a calls section to your Privacy Policy

  5. Update your popups and sign-up forms

Step 1: Turn on the phone checkbox at checkout

Where: Shopify admin › Settings › Checkout › Marketing opt-in

  1. Under Marketing opt-in, turn on the SMS option. This adds a phone checkbox at checkout so customers can choose to hear from you.

  2. Leave the checkbox unticked by default. Consent only counts when the customer ticks it themselves.

If SMS is already on, skip this step.

Step 2: Change the wording next to the checkbox

Where: Shopify admin › Settings › Checkout › Marketing opt-in

Replace the SMS checkbox label and the disclaimer under it with the two texts below, then save.

Disclaimer

By checking this box, you agree to receive recurring marketing calls and texts from [Store name] at the phone number provided, including cart reminders and calls made with automated technology and an artificial or AI-generated voice. Consent is not a condition of purchase. Calls may be recorded. Msg & data rates may apply. Reply STOP or say "stop" on a call to opt out. Reply HELP for help. View our Privacy policy and Terms of service.

Don't see a text box? Scroll down to Checkout language, click Manage checkout language, type SMS in the filter, and edit the same two fields there.

Step 3: Add a calls section to your Terms of Service

Where: Shopify admin › Settings › Policies › Terms of service

Paste this at the end of the page under its own heading, then save.

Heading

Marketing Calls

Text

If you opt in, [Store name] may call the phone number you provided with marketing calls, such as reminders about items left in your cart. These calls may be made with automated technology and an artificial or AI-generated voice, and the caller says at the start of each call that it is an AI assistant. Your consent to these calls is not a condition of any purchase. Calls may be recorded and transcribed. You can stop calls at any time by saying "stop" during a call, replying STOP to any text from us, contacting us at [support email], or asking us in any other reasonable way. Your carrier's standard rates may apply.

Step 4: Add a calls section to your Privacy Policy

Where: Shopify admin › Settings › Policies › Privacy policy

Paste this at the end of the page under its own heading, then save.

Heading

Phone Calls

Text

If you agree to receive calls from [Store name], we collect your phone number and, for each call, its date, length and outcome, a recording and a written transcript. We use this information to place the calls you agreed to, answer your questions, help you complete an order, keep a record of your consent and opt-out choices, improve our calls, and meet our legal obligations. Calls are placed for us by service providers, including providers of AI voice technology, who process this information only on our behalf. No mobile information, including your consent to be called, will be shared with third parties or affiliates for marketing or promotional purposes. We keep call recordings only as long as we need them for these purposes. To stop calls, say "stop" during any call, reply STOP to any text from us, or contact us at [support email].

Step 5: Update your popups and sign-up forms

Where: Klaviyo, or any other tool where you ask for a phone number

Every form that collects phone numbers needs the same consent. Replace the text under the phone field with the text below, and link the last sentence to your two policies.

Text under the phone field

By submitting this form, you agree to receive recurring marketing calls and texts from [Store name] at the phone number provided, including cart reminders and calls made with automated technology and an artificial or AI-generated voice. Consent is not a condition of purchase. Calls may be recorded. Message frequency varies. Msg & data rates may apply. Reply STOP or say "stop" on a call to opt out. Reply HELP for help. FAQ

Can I call customers who already subscribed to SMS?

No. Their consent covered texts only. Only customers who opt in after these changes go live can get AI marketing calls.

Can the checkbox be ticked by default?

No. A pre-ticked box is not valid consent. The customer has to tick it.

Do I need to update every form?

Yes. Any place you collect phone numbers (checkout, popups, landing pages, account sign-up) needs the same consent wording.

This wording follows the US federal rules for marketing calls (TCPA). It is not legal advice. If you have a lawyer, ask them to review it before you publish.
